Patient Rights, Informed Consent and Data Protection in Home Care
What are the rights of patients and families receiving home care? Informed consent, privacy, respect, the right to complain and protection of health data.
Home care is health care delivered in the patient's most private space, their home, which makes respect for rights and privacy even more important. Knowing these rights improves quality and builds a safe care relationship.
| Right | In home care |
|---|---|
| Information | Clear information on procedures, purpose, risks and alternatives |
| Consent | Accepting or refusing a procedure |
| Privacy | Bodily privacy during care and confidentiality |
| Respect and dignity | Courteous treatment for everyone |
| Safety | Safe, hygienic, standard-compliant care |
| Personal values | Respect for beliefs, culture and lifestyle |
| Complaints | Ability to raise concerns |
Informed consent
Consent given freely after adequate, understandable information. In home care this applies to procedures such as IV therapy, catheterisation and injections, starting physiotherapy, personal care such as bathing and pad changes, and photographs, even for wound monitoring.
When a patient lacks capacity (advanced dementia, unconsciousness), decisions are made through a legal representative or relatives in line with regulations, while still informing the patient as far as they can understand and valuing their views.
Privacy
Do not leave the body unnecessarily exposed, close doors and curtains, consider the patient's preferred gender of carer, never share private information seen or heard at home and respect belongings and household routines.
Health data protection
Health data is special category personal data under data protection law and needs stricter protection:
- Collect only what is needed for care.
- Store it securely and prevent unauthorised access.
- Do not share without consent of the patient or legal representative (except legal obligations).
- Patients have rights such as knowing what is processed and requesting corrections.
- Take photos or videos only with consent and for a clear purpose.
You may ask your provider how your data is processed and stored.
Responsibilities
Give accurate and complete information about health, medicines and allergies; follow care advice or say clearly if you will not; treat carers with respect and provide a safe working environment; keep appointments and notify changes.
If unhappy: talk directly to the provider's manager first, put it in writing if needed, and you have the right to apply to the relevant official bodies.
In our home care across Yalova we inform patients and families and obtain consent before every procedure, and protect privacy and confidentiality of health data; the same principles apply in Bursa, Istanbul and Kocaeli–Gebze.
